Terms
  • All orders will be governed by the following terms and conditions. This will constitute an agreement between the purchaser (herein called “ Buyer” ) and myoh ( herein called “ seller” ). This supersedes all previous oral and written statements of any kind between parties by their representatives.
Acceptance of Terms and Conditions
  • Unless seller’s authorized agent at seller office accepts, buyer order shall not constitute contract of sale between buyer and seller. Any acceptance of buyer’s order is conditioned upon buyer’s assent to the terms and conditions of this agreement. Any terms or conditions on buyer’s purchase order or elsewhere in any correspondence with buyer, shall not bind seller unless agreed in writing at seller’s office by seller authorized officer, stating specifically and approving an amendment to this agreement. Buyer shall notify seller in writing of any objection to the terms of this agreement as soon as seller accept an order from buyer. In the absence of any objection by buyer to the terms of this agreement it will be concluded buyer’s acceptance of all terms and conditions and seller will immediately commence performance of an order by buyer without waiting for receipt of seller’s written acknowledgement of an order reaching to buyer.
1. Shipping and Freight

MYOH uses commercially reasonable efforts to communicate the most current and accurate product delivery and inventory information, but there is no guarantee to it.  As soon as an order is received MYOH starts processing the order within one business day. MYOH will use commercially reasonable efforts to ship orders so that they get delivered before or within the estimated delivery window promised at the time of placing the order. The estimated delivery depends on the shipping method selected by the customer.

SHIPPING METHODS

Currently MYOH offers two shipping methods

  • Standard Shipping
  • Rush Shipping

The table below specifies the estimated delivery times and associated fee for all MYOH’s product categories based on the shipping method selected by the customer. These delivery dates are estimates only, and MYOH will not be liable for any damage, loss, or expense incurred by Client if MYOH fails to meet the specified delivery dates. There could be delays in delivery due to reasons beyond our control, such as delayed flights, severe weather conditions, pandemics, natural disasters, strikes or inaccurate delivery scans.

Please note that Rush Shipping is a non guaranteed 10 business days delivery. When you place an order with rush delivery as a shipping method, we prioritize your order in the order processing queue and  we make all efforts to roll out your order from our facility in 1-4 business days ,transit time might take between 1-6 days depending on the location from where we shipped your order. Please note that Rush and Handling Fee cannot be refunded if we could not deliver your order within 10 business days.  We are not liable for any loss, damage or any other expense incurred in anticipation that order will be delivered within 10 business days by selecting a rush fee option.

Client agrees that MYOH may make partial shipments of Products, and each Product shipment will constitute a separate and independent transaction. All Products will be packaged in the manner determined by MYOH, unless otherwise requested by Client and agreed to in writing by MYOH.

MYOH shipping and handling charges include any surcharges for over-sized items. Any special delivery requirements must be submitted to MYOH by writing an email to info@myohamerica.com

2. Payment Terms
  • Only upon approval by seller’s credit department, shipments and deliveries will be made of the orders for all items. Until credit is approved, orders will be shipped only after payment in advance has been paid.
  • Buyer should submit credit application and references to expedite credit approval.
  • Other than specifically agreed upon in writing, payment terms are Net thirty (30 days) from the date of seller’s invoice. Any past due balances will be subject to an interest of two percent (2%) per month and will be added to past due balances. Buyer will be responsible for costs and expenses and attorney’s fees incurred to collect past due balances.
  • On selecting "Net 30 days payment" option under Payment method section at the time of opening your account with us, you agree to our Credit Policy.
3. Cancellations
  • Buyer cancellation of an order will subject to service charge incurred in processing of an order and may be charged to buyer. There are certain orders at the sole discretion of seller which once placed cannot be cancelled. Seller will prior inform buyer of such orders.
4. Accident or Malfunction
  • In the event there is malfunctioning or an accident which involves the product manufactured or sold by seller, buyer will promptly inform seller and in any event within thirty (30 days) of such incident. Buyer will cooperate and provide support to the seller in the investigation of such incidents. Buyer also agrees to defend, protect and save seller harmless in the event buyer fails to give notice to seller and do not co-operate.
5. Buyer Agreement to Defend
  • Buyer agrees to defend, protect and save seller harmless against all suits at law or in equity and from all costs of such suites, reasonable legal fees, expenses, damages, claims and demands arising out of or awarded in connection with any goods: a) sold or supplied to buyer by seller that are not maintained and operated in accordance with seller’s recommended procedures or b) sold or supplied to buyer by seller to meet buyer’s specifications, requirements or instructions.
6. Warranty of Decorative Hardware
  • Seller warrants for the lifetime of the original consumer purchaser that decorative hardware will be free from defects in material and workmanship.
  • Mechanical Warranty: Seller warrants for the lifetime of the original consumer purchaser that the decorative hardware products will be free from mechanical defects. Mechanical Warranty Except as otherwise provided below, Seller warrants to the original buyer that each product shall be free of mechanical defect for as long as the buyer occupies the residential premises upon which the product was originally installed.
  • Finish Warranty  Seller’s Lifetime Finish Warranty and Limited Finish Warranty for the different Finishes:
  •  Lifetime Finish Warranty:  Seller warrants the polished nickel, bright chrome finishes over brass shall be free from defects in material and workmanship from tarnishing, flaking, pitting, and discolouring for the lifetime of the applicable product as long as the original buyer occupies the residential premises upon which the product was originally installed.
  • Limited Finish Warranty: The finish on seller products is protected by a durable lacquer designed to maintain the beauty and quality of the seller product. For seller products purchased with a Limited Finish Warranty, seller warrants the finish shall be free from defects in material and workmanship from tarnishing, flaking, and discolouring for either a) five (5) years from date of purchase for interior use or b) one (1) year from the date of purchase for exterior use; as long as the original buyer occupies the residential premises upon which the product was originally installed.
  • Living Finishes: Finishes Such as Pewter, Oil Rubbed Bronze, Aged brass, Brush nickel, Brush copper, Brush Brass etc. are living finishes.  These finishes age with use and with geographical and atmospheric conditions. These changes in finish are not manufacturing defects and are not covered by this warranty.  Due to the nature of these living finish products, they will wear over time. This is inherent characteristic of a living finish product.  No finish warranty is offered on living finish products, which are designed to age and improve over time.
  • What does warranty not cover?
  • a) Seller products are manufactured to high Standards and good manufacturing practices and processes.  Best grades of materials are used to produce them however the process like castings involves hand craftsmanship and hand applied finishes, there could be casting imperfections or surface blemishes which were allowed by our strict quality control people, These should not be considered as unacceptable quality but the best quality given nature of processes and craftsman ability we could obtain. All final decisions of Quality remain exclusively in the discretion of Seller.
  • b) Any Seller’s product which has been damaged as a result of installation contrary to any of Seller’s written installation instructions is not covered by this warranty.
  • c) Seller product having a defect caused by neglect, misuse, abuse or unreasonable or extraordinary use or maintenance is not covered by this Warranty, including use in a commercial application.
  • d) Any Seller product having a defect due to use of paints, solvents, or other chemicals is not covered by this Warranty.
  • e) Any Seller product that is used in combination with other than those manufactured by Seller and designated for use with the Product is not covered by this Warranty.
  • f) This Warranty is not transferable. Therefore, no transferee is covered by this Warranty. Remedies if a claim is made under this Warranty and, after investigation by Seller, proves to be valid, seller will, at its sole option, either repair or replace the defective product. Upon such repair or replacement, the original remaining Warranty period will continue in effect and be applicable to the repaired or replacement of the seller product. If a seller product, which is covered by this Warranty has been discontinued at the time of repair or replacement or if seller determines, in its sole discretion, that such repair or replacement is inappropriate, seller reserves the right to refund the original purchase price of the product. Except as expressly provided in the Warranty to the contrary, Seller shall not be obligated or liable for labour or other costs related to installation, repair or replacement of a seller product or for loss of, or damage to, any material which is not sold by seller. Any product believed to be defective as covered by this warranty may not be returned without prior written authorization.
  • g) All claims must be made within thirty (30) days from the discovery of the alleged defect(s). Each claim must be in writing and sent to address below and be accompanied by a proof of purchase. If requested must permit inspection of the product By Seller or its representatives. If, after investigation, Seller determines that the claim is valid, the remedy will be performed by or on behalf of Seller in accordance with the above heading, “Remedies”. Limitation of Liabilities Except as expressly provided in this warranty, (a) seller makes no warranties, and disclaims all, warranties, representations and guarantees (whether express, implied or statutory), including, but not limited to, any implied warranty of merchantability or fitness for a particular purpose, and (b) seller shall not be obligated or liable for labour or other costs related to installation, repair or replacement or for loss of, or damage to, any material which is not sold by seller. Seller shall not, in any event, be liable for any consequential or incidental damages suffered by purchaser. Some states do not allow exclusion of implied warranties, exclusion or limitation of incidental or consequential damages or limitations on the length of an implied warranty, and therefore some or all of the last sentence under the above heading, “remedies” and the immediately preceding two sentences may not apply
7. Functional Hardware (Cabinet Organizers and Furniture Fittings)
  • Seller warrants all functional hardware products to be free from any defects in material and workmanship.
  • This warranty is valid for 1 (one) year from the time of original purchase of the product.Seller will send original purchaser without any charge, a new product to replace any defective product subject to this warranty. This warranty is a warranty of replacement only. Seller does not warrant removal of defective product and installation of the replacement product. This warranty does not cover products which were not installed correctly or misused and mishandled by using products for the load to excessive load or specifications to which product is meant to use and built for the purpose. Should Seller has discontinued, or item is obsolete, Seller reserves the right to replace the defective product with current offering
8. Product Variation
  • Since most of the manufacturing and designs are work of art and are hand crafted and finished. There are variations within a lot and on lot to lot basis in colour and finishes.
9. Returns

At MYOH, our cause is to bring joy and happiness to your life through our products as you use and experience them. If for any reason you are not satisfied with your purchase, please contact us to return your items within 30 days of the delivery date with proof of purchase.

Please note that returns are not accepted for made to order, custom finishes and products like furniture, mirrors, shelving systems, other large items, items that have been installed, opened and are not in original packaging. Other exclusions may apply, please contact us for further details.

Upon return we will inspect returned items and if they can be restocked and the return is as per our return policy and terms of sale we will give a credit or refund will be issued for the purchase price. Any taxes charged will be refunded as per applicable laws.

Handling or delivery fees are non-refundable unless the return is because of manufacturing defects or a transit damage.

MYOH reserves the right to refuse a return of items that are not received in original unopened condition.

Made to order/Custom Products 

All made to order products or our standard products in custom sizes or custom finishes are entered the same day in our system and processing starts immediately upon receipt of order and our team starts making drawings and other actions are taken to build to your specifications. This would mean any made to order, custom size and finish items cannot be cancelled, changed, returned, or refunded once an order is placed.

REFUNDS

The refund process will be initiated only once we have received the product back in our warehouse and we have completed all quality checks and verifications at our end. The mode of refund may depend on the mode of payment used at the time of placing the order.

    1. 1)   If return request is made after 30 days of delivery or if return is dispatched after one week of receiving RMA form or if product is returned in poor packaging, used, damaged or not in its original packaging, we cannot accept the returned items and cannot give a refund.
    2. 2)   If the product is received unopened and in its original packaging. We will make refund subject to a 25% restocking charge minus any shipping charges
    3. 3)   Credit Card Refunds : Your refund will be processed to the same credit card used to place your order. An email confirmation will be sent after a refund has been processed. Refund times will depend on credit card company’s policies
    4. 4)   Bank Transfer Refunds : If payment of order was done through bank transfer our team will either issue store credits which you can use on any future purchase or you can provide us with your bank transfer details. We will send an email notifying that the refund has been processed from our end, and the refunded amount will be visible on your bank statement shortly thereafter.
    5. 5)   Orders Placed through NET30 : A credit memo with 25% restocking fee deducted will be issued which can be applied on the same invoice if still unpaid or on the next future invoice.
    6. 6)   All return shipping costs are the responsibility of the customer and any shipping charged at the time of purchase is not refundable.
    7. 7)   The length of time your return is in transit is beyond our control; although once we do receive your return we will process it as quickly as possible. You need to allow at least 10-14 business days to receive and process your return. Although we will refund the money within 3-4 business days after processing your return, your bank or credit card company may request time to process your refund and for it to reach your account. We will notify you via e-mail once we’ve received and processed the return product(s).

DAMAGED/DEFECTIVE OR WRONG PRODUCT(S) DELIVERED:

All Products are considered to be in good condition and error free when delivered, unless a material Defect, packaging damage or order error is reported by client to the MYOH team by e-mail at info@myohamerica.com within five (5) -business days of Product delivery to the shipping address on record. In the unlikely event of a damaged, defective or different item delivered to you, we will provide a full refund or replacement if available. We will contact you to ascertain the damage or defect in the product prior to issuing refund/replacement.

 

Process

    1. 1)   Clients should inspect all deliveries immediately upon arrival, and should make note of any damage to boxes when signing for Product deliveries.
    2. 2)   No replacements/refunds will be given for Products moved or re-shipped after delivery to the shipping address on record.
    3. 3)   If a product is damaged or defective you must notify us by sending an email at info@myohamerica.com within 5 days of receipt with photos showing the damage or defect.
    4. 4)   Defective Products and Products delivered in error may be returned to MYOH only after obtaining a Return Material Authorization form alongwith return instructions from MYOH. Our team will arrange for pickup of such Products.
    5. 5)   If MYOH determines after inspection that such returned Products contain a material Defect, MYOH will either issue a refund or will replace the products free of charge. If MYOH determines that such returned Product was delivered in error, MYOH will correct such error and re-deliver the Product ordered to Client. “Defects” are defined as imperfection in material or workmanship that will impair the use of the Products.
    6. 6)   Please do not ship anything back without prior authorization. We are not responsible for shortage claims beyond 5 days of delivery date.
    7. 7)   This policy does NOT cover (i) Defects caused by improper product storage, handling, assembly, maintenance, or use; (ii) Defects occurring to the Products after purchase due to Product modification, intentional damage, accident, misuse, abuse, or negligence.
10. Delays
  • Seller will not be liable for any delays in production and delivery of goods due to a) mechanical failure at manufacturing facility of tools, machines or other equipment’s, accidents, labour shortages, unions, strikes, fire, flood, wars, acts of God, delay from suppliers, transportation delays, embargos, power cuts and other shortage of resources for energy, other priorities, limitations or other regulations posed by Federal, state or local government bodies or agencies thereof b) any cause beyond control of seller.
11. Governing Law
  • Both buyer and seller execute all orders with reference to the laws of State Of Delaware, United States.
12. Binding Effect
  • Provisions of any order shall bind and inure to the benefits of seller and buyer and their respective successors and permitted assigns. However, this agreement or part thereof cannot be assigned by buyer without prior consent of seller.
13. Prices
  • Myoh has the right to change any prices and specification without notice, products in its catalogue, website or other communications that does not prohibit such change.

15. Sample Program
  • myoh has encouraging sample program to help our channel partners win business. We understand that samples assist you in seeing the finish in person before making a purchase.
  • Ordering display samples for library: myoh can offer 75% discount if you need samples to keep in your library. For this you may please write to info@myohamerica.com detailing the display samples you need for your library, upon review we will send you a discount coupon code to be applied on your shopping cart page so as to give 75% discount over MSRP for the display samples.
  • Ordering samples for 30 days: We refund back the amount paid for the samples as long as they are returned within 30 days of delivery. In effect you pay only for order ahndling fee and return of samples.
  • Step 1: How to place sample order
  • Just place your order online as you would a regular order and email us on the same day at info@myohamerica.com that this is your sample order along with your order #. For customised sample write us through our contact us page and mention the item Code, finish, size and your personal contact details. Allow us 2 business days to create a new sku and we will get back to you with the link of the item to checkout online.There is a flat order handling fee of USD 19.95 on ordering samples.
  • Step 2: After placing sample order
  • After placing your sample order allow us 2 weeks for delivery of samples. Upon receipt you may place the sample on hardware or show it to your client. If you return the sample in used or unused condition within 30 days, we will refund back the amount paid for the sample minus the shipping charges.

Buyer agrees to hold seller harmless from any and all applicable governmental and regulatory taxes or charges whether or not invoiced by seller to buyer including interests and penalties or any incidental expenses thereupon in this connection
17. Interpretation
  • Each provision of this agreement will be interpreted in a manner as to be effective and valid under applicable law, but if any provision of the agreement should be prohibited or invalid under appropriate law, that provision will be deemed deleted and the rest of the provisions will be in full force and effect. The headings of the different sections of this agreement are for the purpose of convenience only and do not affect construction or interpretation of any of its provisions.
